Background
The National Association of Immigration Judges (NAIJ) is the professional association representing the country’s immigration judges, who are DOJ employees within the EOIR rather than independent Article III judges. Representing more than 460 judges, the NAIJ objected to the speech restrictions imposed on its members and was the plaintiff in the litigation challenging them, a case the Supreme Court resolved against it on procedural grounds in 2026.
